The ACO
shall forward a copy of the
final decision and the evidence of the contractor's receipt of
the final decision to DCMA's Contract Disputes Resolution
Center.
For
debt deferments, the ACO shall coordinate with local counsel
to assess litigative risk. The ACO shall provide
the deferment of collection package to HQ DCMA, Contract
Business Operations, through appropriate CMO and District
channels.
The ACO shall immediately report to
HQ DCMA, Contract Business Operations, any significant changes
in the contractor's financial condition or other factors that
the ACO believes might affect the CFO's decision to continue the
deferment.
If the contractor has an appeal pending or action filed under
the Disputes clause of the contract, HQ DCMA, Contract Disputes
Resolution Center, shall immediately notify the ACO and HQ DCMA, Contract
Business Operations, when the contractor files an appeal, the statutory
period for filing an appeal expires, or the Armed Services Board of Contract
Appeals (ASBCA) or the United States Court of Federal Claims render a decision
on the appeal. When the Board/Court renders a decision, the ACO shall
provide DCMA, Contract Business Operations, an updated deferment
of collection package. The ACO shall not initiate any
collection actions for any debt in a deferment status without
the prior approval of the cognizant CFO.
