Subject: Class Determination of Domestic Non-Availability
(DNAD) for Fasteners (INFORMATION)

Target Audience: CMO Commanders and Deputy Commanders, ACOs, QARs
New Information/Guidance:
- The Under Secretary of Defense for Acquisition,
Technology and Logistics (USD(AT&L)) has
determined that satisfactory quality and sufficient quantity of compliant
specialty metals in the form of fasteners cannot be procured as and when
needed. As a result, contracting officers may procure end items, and
components thereof, containing fasteners notwithstanding the country where
the specialty metals contained in such items were melted or produced.
- Contractor corrective actions plans (CAPs) (reference
DCMA
Information Memorandum 07-042, Specialty Metals, December 8, 2006)
may rely on this DNAD for prior and future procurements.
- This DNAD will be rescinded when compliant
sources of specialty metal fasteners are identified that can provide material
in sufficient quantity, quality and at reasonable prices. As a result,
contractors should strive to achieve compliance as soon as possible.
- This DNAD,
and any others granted by USD(AT&L) with
Department-wide applicability, was posted on our website at http://www.dcma.mil/dnad/.
- As mentioned in DCMA Information
Memorandum 07-042, Specialty Metals, December 8, 2006, DCMA has
engaged the Services and Defense Agencies regarding a streamlined process
for One-Time Waiver (OTW) approvals and the resolution of withholds
associated with conditional acceptances. Essentially, we are
recommending that authority for (1) dispositioning
the withholds associated with prior conditional acceptances and (2) determining
whether a contractor should be granted the OTW should be vested in the
contracting officer to whom the contractor submitted its
CAP. DCMA will evaluate and approve
only broad-based CAPs and OTW requests. CAPs and OTW
requests submitted on a shipment, contract or program basis remain the
responsibility of the Procuring Contracting Officer. To date, DCMA has received letters of
delegation from USD(AT&L), Navy and Air Force. We expect the Army’s delegation shortly. As a result of this delegation, we are
preparing additional instructions to guide DCMA contracting officers in
the processing of broad-based CAPs and OTW
requests. This instruction will be posted
soon.
